GENERAL POLICIES AND PROCEDURES

  • The club shall have the absolute right to make such rules, regulation and restrictions for the use the training facility as it may deem necessary.
  • All signs and regulations posted in the club shall be considered as integral part of the rules and regulations.
  • No member of the club shall advertise or permit his membership to be advertised for sale. Memberships are non assignable, non transferable and non-voting.
  • Charges and fees for services and facilities are governed by the club and may be subject to notifications from time to time.
  • In the event the club needs to expand the facilities provided to the members and in the event, any construction is required for the same and in the event, the club closes down temporarily for such construction, it will make reasonable effort to substitute another facility for its members until such construction is completed.
  • No refunds shall be made for memberships dues paid, except for the event if the member dies or is permanently disabled, and is in a position not to receive all services for which he was eligible, he and his estate shall be relieved from the obligation of making payments for services other than those received prior to death or onset of disability, and if he has prepaid any sums for services so is allocable to service he has not received shall be promptly refunded to him or his legal heirs. However, in the event he commences using the services then he can claim no refund and no refund will be payable to him or any persons claiming through him. As used herein, the term disability means a condition which precludes the member from physically using the facilities after such condition is verified by a physician and certified of his disability. No refunds shall be given for temporary disabilities.
  • Members should maintain silence while using the GYM. Any member who is loud, offensive and bothersome to other members or behaves otherwise in an unbecoming manner or who is cited for infractions of rules and regulation may be suspended or expelled from the club. In the event of termination, the unused portion of any advanced payment shall be forfeited to the club.
  • Hours of operation posted at club premises are subject to change as to the directives of the club authorities.
  • Smoking is not permissible in the club premises.
  • All members and guests must sign in the register kept at the reception desk upon entering the club.
  • Club services may only be used by "THE CAMP" members in good standing. A member whose Membership (i.e. Health Club Membership) has expired must renew it in advance prior to expiry of the same in order to take advantage of his privileges.
  • The club is not responsible for lost and found items. Items if found will be immediately placed in public lost and.
  • Any notice required or permitted to be given to members shall be considered duly given when personally delivered to him/her or mailed to the respective address as it appears in the membership agreement or as subsequently changed by written notice issued to the club. Any notice required or permitted to be given by any member to the club shall be considered duly given only when the same is received by the membership office of the club in writing.
  • No solicitation is allowed in club or parking lot. It is exclusively reserved for the club.
  • Members shall be restricted from any personal promotional activities and/or any commercial tete-a-tete in and around the club premises. Any violation may lead to cancellation of membership and/or forfeiture of deposits at the sole discretion of "THE CAMP".
  • Belongings may not be left in daily lockers overnight. Items left over will be removed by opening the locks. The club will not accept responsibility for items removed from lockers.
  • No member shall solicit or perform personal training services within the premises.III. GUESTS
  • No member shall bring any individual to perform personal training service.
  • All guests must register upon entering the club.
  • All guests must execute a waiver and release of liability and Indemnity Agreement.
  • Former members and members restricted from the club shall not enter the Gym premises as guests.
  • Out-of-town guest will be charged guest fees.
  • The club reserves the right to refuse anyone who is not properly attired and/or personally clean.
  • Any guest found in the club who has not paid the guest fee will be charged double and will no longer be able to use the club. Members are responsible for their Guests. (see membership agreement #5)
  • All guests must abide by the club rules and regulations IV. CHILDRENA. Children under the age of 13 are not allowed in the club except for attendance of classes and events organised especially for them.V. WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENTYou (buyer, each member and all guests) agree that if you engage in any physical, exercise or activity or use any club facility on the premises, your assumption of risk, includes without limitation your use or any exercise equipment (mechanical or otherwise) in the locker room, sidewalk, parking lot stairs, steam room, lobby area or any equipment in the club facility. Member agrees to assume the risk in his or her participation in any activity, class, program, instructions, or club-sponsored event. You agree that you are voluntarily participating in the aforementioned activities and using the club facilities and premises and assume all risk of injury, illness, damage or loss to you or your property that might result including without limitation, any loss or theft of any personal property. You agree on behalf of yourself (And on your personal representatives, heirs, executors, administrators, agents and assigns) to release and discharge Club (and our affiliates, employees, agents, representatives, successors and assigns) from any and all claims or damages or causes of action known or unknown arising out of the usage of Club facilities, whether active or passive or of any action or advice of its affiliates, employees, agents, representatives, successors and assigns. This waiver and release of liability includes, without limitation, injuries which may occur, as a result of (A) your use of any exercise equipment or facilities. (B) Club's exercise equipment or facilities, (C) Clubs Instruction or supervision Including personal training and (D) you slipping and falling while on the facility or any found location.

    • HEALTH CLUB :

  • Inside the club premises members must always wear T-shirt (covering the chest and back).
  • Foot covering (i.e. tennis or aerobic shoe) must be worn at all times in all exercise areas, as well as in the entire club. Socks and sandals are not allowed.
  • Members must be properly attired in standard workout clothes (gym shorts, jogging suits) while entering the exercise area.
  • Members should always be aware of the circuit rules. Do not cut it on the circuit or do sets if other members are waiting. Please see hand out on training principles.
  • Profanity is not permitted inside the gym.
  • Members shall not yell or scream while using the gym.
  • Use of the equipments should be as per the instruction of the head coach or trainers.
  • Weights should be returned to proper racks after use.
  • Members should always have a "spotter" when using heavy weights.
  • No littering or leaving debris on the gym floor is permitted.
  • Members should always use a towel when using the equipment(s).
  • No dropping of weights. If due to dropping of the weights any damage occurs to the club property then the members are liable to pay for it.
  • Use of hair dryers at the club premises is strictly prohibited.
  • Shaving within the club premises is strictly prohibited.

  • Eating and drinking is permitted in the lounge only. No one should eat and drink in the gym, locker room or spa area portion of the premises for any reason whatsoever. By execution of this agreement, you agree to Indemnify and hold harmless the club from any loss, liability, damage or cost that the club may incur due to your presence at the club facility. You further expressly agree that the foregoing release, waiver, and indemnity agreement is executed free from coercion and undue influence out of free will and self prudency and shall never draw any disputes or proceedings before any court of law In Kolkata.YOU ACKNOWLEDGE THAT YOU HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY, AND EXPRESS ASSUMPTION OF RISK AND INDEMNITY AGREEMENT. YOU ARE AWARE AND AGREE THAT BY EXECUTING THIS WAIVER AND RELEASE, YOU ARE GIVING UP YOUR RIGHT TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST THE CLUB FOR NEGLIGENCE, OR FOR ANTI-DEFECTIVE PRODUCT ON ITS PREMISES. YOU HAVE READ AND VOLUNTARILY SIGNED THE WAIVER AND RELEASE AND FURTHER AGREE THAT NO ORAL PROMISES, STATEMENTS, OR INDUCEMENT APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE.VI. SEVERABILITYThese provisions of this contract are severable and if any provision is determined to be illegal or unenforceable, the remaining provisions and any partially enforceable provisions shall nevertheless be enforceable. The club's failure to enforce any remedy or provisions in this contract shall not be construed as a waiver or such remedy or provisions.VII. GOVERNING LAWThis agreement shall be constructed in accordance with the laws of the city of Kolkata with territorial, pecuniary jurisdiction and venue as applicable for courts applicable in Kolkata city only.IX. INTEGRATION - ENTIRE AGREEMENTThis agreement constitutes the entire exclusive agreement between the parties hereto and cancels and supersedes all prior promises, representations, understandings, and/or agreements between the parties. The agreement maybe modified only by an Instrument in writing signed by all parties signing these presence, however the club or any assignee of this agreement are authorised to correct patent errors to the agreement (and other related documents).
